Welcome to Digimcy, a digital marketing agency located at Dhaka, Bangladesh. By accessing and using our website at digimcy.com and engaging with our services, you agree to be bound by the following Terms and Conditions. Please read them carefully.
General Agreement
These Terms and Conditions govern your use of the website and all services provided by Digimcy. By using our website and services, you signify your acceptance of these terms. If you do not agree, you should not use our services.
Services Provided
Digimcy provides a comprehensive range of digital marketing services, including but not limited to:
- SEO (Search Engine Optimization)
- VSMM (Social Media Marketing) & Facebook Marketing
- Google Ads
- Web Design and Development
- Video Production, Graphic Design, and Branding
- Virtual Assistant Services
- Artificial Intelligence and Marketing Consultancy
The specific services provided to you will be detailed in a separate service agreement, proposal, or contract.
Client Responsibilities
As a client, you agree to:
- Provide timely and accurate information, access, and materials necessary for us to perform our services.
- Cooperate with us in good faith.
- Make timely payments for all services as outlined in your service agreement.
- Ensure that all content and materials provided to us are your property or that you have the legal right to use them.
Payments and Fees
Fees for our services will be outlined in your service agreement. All invoices are due and payable within 7days of the invoice date. Late payments may be subject to a late fee of 1.5% per month.
Confidentiality
We agree to keep all your business information confidential and will not disclose it to any third party without your prior consent, except as required by law. You agree to keep our proprietary information, strategies, and methodologies confidential.
Intellectual Property
After you complete full payment for our services, we immediately transfer all intellectual property rights to you. These rights include, but are not limited to, copyrights and trademarks related to the final work product we create specifically for your business. Moreover, Digimcy keeps the right to showcase the work in our portfolio for promotional purposes. However, if a separate agreement states otherwise, we will follow that instead.
Limitation of Liability
Digimcy does not accept liability for any indirect, incidental, special, or consequential damages. These include, but are not limited to, loss of profits, data, or business interruption resulting from your use of our services. Furthermore, our total liability to you for all claims will never exceed the total amount you paid for the services during the three (3) months before the claim.
Termination of Service
Either party may terminate the services by providing 30 days’ written notice. However, if termination occurs, Digimcy will bill you for all services completed up to that date. Therefore, both parties remain responsible for obligations already incurred.
Governing Law
These Terms and Conditions follow the laws of Bangladesh. Therefore, any disputes will go to the courts of Dhaka for resolution. Additionally, both parties agree to comply fully with the applicable legal framework.
Changes to These Terms
Digimcy reserves the right to modify these Terms and Conditions at any time. We will notify you of any changes by posting the new Terms on this page.
